IN THE MATTER OF CANPOL HOLDINGS (A.K.A. COMMERCIAL AND PRODUCTIVE ENTERPRISE CANPOL COMPANY LTD.) AND PAUL JAN BORKOWSKI

Order Under Section 174

WHEREAS following a hearing under sections 144(1) and 144.1 of the Securities Act, S.B.C. 1985, c. 83 (the “Old Act”), now sections 161 and 162 of the Securities Act, R.S.B.C. 1996, c. 418, into the conduct and affairs of Canpol Holdings (a.k.a. Commercial and Productive Enterprise Canpol Company Ltd.) and Paul Jan Borkowski, the Commission issued a decision on September 6, 1996, in which it ordered, inter alia, under section 154.2 of the Old Act, now section 174 of the Act, that Borkowski pay prescribed fees or charges for the costs of or related to the hearing incurred by the Commission and the Executive Director, those costs to be determined following further submissions from the parties;

AND WHEREAS on November 20, 1996, Commission staff submitted a bill of costs of $9,695.00, representing prescribed fees and charges incurred by the Commission and the Executive Director in relation to the hearing;

AND WHEREAS the submission of Commission staff was sent to Borkowski on November 20, 1996;

AND WHEREAS no submissions were received from Borkowski regarding Commission staff’s bill of costs;

NOW THEREFORE the Commission orders under section 174 of the Act and in accordance with section 22(1), Item 38(a), (b) and (c) of the Securities Regulation, B.C. Reg. 196/97, that Borkowski pay the costs of or related to the hearing in the amount of $9,695.00.
