AND

IN THE MATTER OF ERON MORTGAGE CORPORATION, CAPITAL PRODUCTIONS INC., BRIAN SLOBOGIAN AND FRANK BILLER

Order Under Section 174

WHEREAS following a hearing under sections 161(1) and 162 of the Securities Act, R.S.B.C. 1996, c. 418, into the conduct and affairs of Eron Mortgage Corporation, Capital Productions Inc., Brian Slobogian and Frank Biller, the Commission issued a decision on February 16, 2000, in which it ordered, inter alia, under section 174 of the Act, that the respondents pay on a joint and several basis the prescribed fees or charges for the costs of or related to the hearing incurred by, or on behalf of, the Commission and the Executive Director, provided that Biller’s liability to pay such prescribed fees and charges shall not exceed 25% of the total, the amount to be determined following further submissions from the parties ;

AND WHEREAS on March 1, 2000, Commission staff submitted a bill of $279,366.91, representing prescribed fees and charges incurred by the Commission and the Executive Director in relation to the hearing;

AND WHEREAS the submission of Commission staff was sent to the respondents on March 7, 2000;

AND WHEREAS no submissions were received from the respondents regarding Commission staff’s bill of costs in the amount of $279,366.91;

NOW THEREFORE the Commission orders under section 174 of the Act and in accordance with section 22(1), Items 38(a), (b) and (c) of the Securities Regulation, B.C. Reg. 478/95, that the costs of or related to the hearing are $279,366.91, and are payable by the respondents on a joint and several basis, provided that Biller’s portion shall not exceed $69,841.73.
