Costs Order Under Section 174
Background

In a decision dated October 26, 2001, the Commission ordered Robert Kane Garrod to pay hearing costs. At the close of the hearing leading to that decision, Commission staff submitted a bill of costs totalling $10,333.74.
Discussion

We have reviewed the bill of costs submitted by Commission staff. We have two observations. First, the bill includes costs for 46.9 hours of time for staff counsel for a total of $4,380. In our opinion, this is more time than ought to have been necessary to prepare and argue this case. We are therefore reducing this amount to $2,190.

Second, the bill includes costs for two hearing days at $2,000 each for a total of $4,000. We sat for just under an hour on September 11 and less than two hours on September 12. Had counsel better organized the hearing, it could easily have been completed in less than one day. We are therefore reducing this amount to $2,000.

The Commission orders, under section 174 of the Securities Act, R.S.B.C. 1996, c. 418, that Garrod pay $6,143.74.
