Hearing Date and Extension of Temporary Orders


The British Columbia Securities Commission is to determine whether it is in the public interest to make orders under the Securities Act against Rampart Securities Inc. On August 17, 2001, the Executive Director issued a notice of hearing and temporary orders against Rampart. On August 29, 2001, the Commission extended the temporary orders to October 3, 2001.

At the hearing on October 3, 2001, the Commission heard an application from Commission staff to adjourn the hearing and vary the temporary orders.

At that hearing, the Commission

1. adjourned the hearing to April 3, 2002, at 10:00 a.m. at the British Columbia Securities Commission, 12th Floor, 701 West Georgia Street, Vancouver; and

2. considering it necessary and in the public interest, varied the temporary orders to provide that, until the hearing is held and a decision is rendered:
    a) Rampart's registration in British Columbia remains suspended; and
      b) Rampart is prohibited from trading securities except that the following transactions pertaining to funds, securities or property which Rampart may have on deposit, under its control or for safekeeping are exempted from the order and may be entered into and completed by Rampart:

        (i) transactions approved by Rampart's Interim Receiver, Ernst & Young Inc., appointed by the Order of Mr. Justice Spence dated September 24, 2001 (the Interim Receiver Order); and
          (ii) transactions where securities are required to be liquidated, or the securities or security positions are transferred to another member firm of the IDA to conduct the trade, and where such transactions have been consented to by the Interim Receiver in accordance with paragraph 3 of the Interim Receiver Order.
