¶ 1 On August 2, 2012, the Executive Director issued a Temporary Order and a Notice of Hearing (2012 BCSECCOM 306) against Thalbinder Singh Poonian, Shailu Sharon Poonian, Robert Joseph Leyk, Manjit Singh Sihota and Perminder Sihota.
¶ 2 The Executive Director has applied to extend the temporary order until a hearing is held and a decision rendered.
¶ 3 On August 14, 2012, the Commission
- extended the temporary order until September 24, 2012; and
- adjourned the Executive Director’s application to September 24.
¶ 4 On September 24, the parties, with the exception of Mr. Leyk who did not appear although having had notice, applied by consent to adjourn the Executive Director’s application and vary the temporary order.
¶ 5 On September 24, the Commission:
(a) adjourned the Executive Director’s application to February 1, 2013 at 10:00am;
(b) considering it necessary and in the public interest, under section 161(3) of the Act, extended the temporary order until a hearing is held and a decision is rendered;
(c) considering that to do so would not be prejudicial to the public interest, under section 171 varied paragraph 3(b) of the temporary order so that it reads as follows:
(b) each Respondent resign any position he or she holds, and is prohibited from becoming or acting, as a director or officer of any issuer; other than an issuer all the securities of which are owned by him or her; except that Manjit Singh Sihota may act as an officer and director of Richmond Plywood Corporation Limited; and
(d) adjourned this matter to November 27, 2012, when it will set a date for the hearing.
