¶ 1 On May 30, 1988, the Superintendent of Brokers issued a Notice of Hearing and temporary orders against Edward John Carter (Carter) and others with respect to allegations of manipulation of share prices on the Vancouver Stock Exchange and fraud perpetrated on a mutual fund in the United States.

¶ 2 On June 9, 1988, the Commission adjourned the hearing generally and extended the temporary orders until the hearing could be held, and a decision rendered.

¶ 3 In October 1990, Carter was convicted of criminal charges in relation to the conduct at issue in the Notice of Hearing, and sentenced to a period of incarceration.

¶ 4 In October 1993, Carter was released from prison.

¶ 5 On July 17, 2001, the Executive Director issued a Further Amended Notice of Hearing.

¶ 6 On February 18, 2003, the Commission adjourned the hearing generally, and extended the temporary orders against Carter until a hearing could be held, and a decision rendered.

¶ 7 The temporary orders against Carter have now been in effect for over 22 years, and Carter is now 85 years old.

¶ 8 The Executive Director, considering it would not be prejudicial to the public interest to do so, discontinues the proceedings against Carter.
