Revocation of Temporary Order against Terry James Minnie
Background
¶ 1 On October 7, 2004, the executive director:
- a. issued a notice of hearing against Terry James Minnie and Raymond Patrick Shaw; and
b. imposed temporary orders against them, under section 161 of the Act, for a period expiring on October 20, 2004 (2004 BCSECCOM 577).
¶ 3 On March 8, 2007, Minnie was convicted in the Supreme Court of British Columbia of six counts of fraud and one count of theft under sections 380(1)(a) and 334(a) of the Criminal Codeand was sentenced to five years’ in prison. Minnie's convictions were based on some of the facts the executive director alleged in the notice of hearing.
¶ 4 Based on the convictions, on August 21, 2007, under section 161(6)(a) of the Act, the Commission ordered:
- · under section 161(1)(b) of the Act, that Minnie cease trading in, and is permanently prohibited from trading and purchasing, any securities, except that Minnie may trade or purchase securities for his own account through a registrant, if he gives the registrant a copy of this decision;
· under section 161(1)(d)(i) and (ii), that Minnie resign any position he holds as, and is permanently prohibited from becoming, or acting as, a director or officer of any issuer, except an issuer all the securities of which are owned beneficially by him, his wife or his children; and
· under section 161(1)(d)(iii), that Minnie is permanently prohibited from engaging in any investor relations activities (2007 BCSECCOM 501).
¶ 5 On September 27, 2007, the executive director discontinued these proceedings against Minnie (2007 BCSECCOM 582), and applied to vary the temporary orders so that they no longer apply to Minnie.
The Order
¶ 6 Under section 171 of the Act, the Commission, considering that it would not be prejudicial to the public interest, revokes the temporary order against Minnie.
