Foresight Capital Corporation and others - ruling
The panel has considered your July 25, 2006 email to Ms O’Hea, secretary to the Commission (copy attached). This is our ruling.
Fraser's trip to China
1. The panel will not ask Ms Fraser to confirm that she did travel to China. It is notthe panel's function to seek or obtain evidence. That is for the parties.
New evidence
2. If you wish to apply to the panel to reopen the case to introduce new evidence, then you may do so. Your application should provide full particulars of the new evidence and explain why:
- it is relevant, and
- it was not reasonably possible to provide it during the hearing.
You must send a copy of the application to the other parties. Ms MacGregor Bock and the executive director would have the opportunity to respond to it, and you to reply to their submissions, before we rule on it. We would fix those dates when we receive your application.
