Variation Order
Research Capital Corporation
Section 171 of the Securities Act, RSBC 1996, c. 418
Background
¶ 1 On February 27, 2004, the commission issued a decision containing orders against Research Capital Corporation, including an order that Research Capital pay costs to be determined following submissions.
¶ 2 We directed commission staff to file a submission on costs and send a copy to Research Capital by March 31, 2004, and directed Research Capital to file its submission and send a copy to commission staff by April 21, 2004.
¶ 3 On March 26, 2004, Research Capital filed in the Court of Appeal a notice of application for leave to appeal the February 27 decision.
¶ 4 Commission staff filed a submission on costs on March 31, 2004.
¶ 5 On April 15, 2004, Research Capital asked the commission to vary the decision to extend the time for filing its submissions on costs until after the disposition of the appeal it is seeking in the Court of Appeal.
¶ 6 The commission considers that to vary the order would not be prejudicial to the public interest.
Order
¶ 7 The commission varies the order under section 171 of the Act to extend the time for Research Capital to file its submissions on costs to 30 days after the disposition of its application and any resulting appeal.
