Section 161 of the Securities Act, RSBC 1996, c. 418
¶ 1 On the February 5, 2013 set date hearing, the Commission set the hearing dates in this matter for May 13 – 16, 2013 (Hearing Dates).
¶ 2 Between April 24 and 26, 2013, the respondents each requested an adjournment of the Hearing Dates in order to retain counsel.
¶ 3 On April 26, 2013, the Commission held a hearing management meeting. The Executive Director attended, and the respondents Mr. Anderson and Mr. Chua attended without counsel by telephone. The Commission directed, by consent, that if the respondents retained counsel by May 1, 2013, the Commission would adjourn the Hearing Dates to May 21 – 24, 2013. If they did not retain counsel, the hearing would proceed on the Hearing Dates.
¶ 4 On April 30, 2013, counsel for Mr. Anderson requested an adjournment of the hearing beyond May 21 – 24, 2013. The Executive Director took no position on Mr. Anderson’s adjournment request.
¶ 5 On May 2, 2013, counsel for Mr. Chua also requested an adjournment beyond May 21 – 24, 2013.
¶ 6 Having reviewed the submissions of the parties, and considering it not prejudicial to the public interest, the Commission adjourns the hearing generally, and directs the parties to attend a hearing management meeting at 10:00 a.m. on May 22, 2013 to set dates for the hearing.
