Ruling
¶ 1 On April 9, 2013, the executive director issued an amended notice of hearing alleging that Rashida Samji and the other respondents perpetrated fraud, contrary to the Securities Act RSBC 1996 c. 418.
¶ 2 Samji applied for orders declaring that some of the allegations in the notice of hearing are statute-barred under section 159 of the Act, and that other allegations be struck from the notice of hearing on the basis that the Commission has no jurisdiction to hear them.
¶ 3 We find that the application is premature. In our opinion, we cannot properly consider the application without the evidence to be entered in the hearing on the merits.
¶ 4 The respondent can reapply after the hearing on the merits.
