Ruling – Adjournment

Lynne Rae Nickford aka Lynne Rae Zlotnik
dba Lynne Zlotnik Wealth Management

Section 161 of the Securities Act, RSBC 1996, c. 418

      Background
¶ 1 On the October 2, 2012 set date hearing, the Commission set the hearing dates in this matter for November 15 and 20-22, 2012.

¶ 2 On October 18, 2012, Nickford applied for an adjournment, because of ill health.

¶ 3 On November 2, 2012, the Commission adjourned the hearing to January 7, 8, 11 and February 4 and 5, 2013, and issued a temporary order, by consent, under section 161(1) of the Act until a hearing is held and a decision is rendered.

¶ 4 On November 26, 2012, Nickford again applied to adjourn the hearing because of ill health.

¶ 5 On November 27, 2012, the Commission, by consent, adjourned the hearing to June 17-20, 2013.

¶ 6 On May 10, 2013, Nickford applied to adjourn the hearing for a third time since the matter was set down in November 2012, because of her continuing ill health. The Executive Director opposed this application.
      Ruling
¶ 7 Having reviewed the submissions of the parties, and considering it not prejudicial to the public interest, the Commission rules that the hearing is adjourned generally on the following terms:
      1. the parties attend a hearing management meeting at 10:00 a.m. on June 17, 2013 to set dates for the hearing;

      2. Nickford discloses to the Executive Director, as required by section 2.6 of BC Policy 15-601, the evidence she intends to produce at the hearing, at least 30 days prior to the hearing; and

      3. considering that disclosure would be unduly prejudicial to Nickford, the public be excluded from the submissions of the parties filed in all three adjournment applications.
