Section 161(1) of the Securities Act, RSBC 1996, c. 418
Introduction
¶ 1 This is an order under sections 161(1) and 161(6)(c) of the Securities Act, RSBC 1996, c.418.
Background
¶ 2 Alan Marsh Shuman is subject to orders made by the Ontario Securities Commission on November 4, 2008 in Re First Global Ventures, S.A. and the New Brunswick Securities Commission on May 30, 2008, in Re First Global Ventures, S.A., imposing sanctions on him.
Order
¶ 3 After providing Shuman an opportunity to be heard, and considering staff’s submissions and considering it to be in the public interest, we order:
1. under section 161(1)(b) of the Act, that Shuman cease trading in, and is prohibited from purchasing, securities and exchange contracts for until November 4, 2028, except that Shuman may trade and purchase securities in accordance with the terms of the OSC decision;
2. under section 161(1)(c) of the Act, that any or all of the exemptions set out in the regulations do not apply to Shuman until November 4, 2028, except for those exemptions necessary to enable Shuman to trade and purchase securities in accordance with the terms of the OSC decision; and
3. under section 161(1)(d)(ii) of the Act, that Shuman is prohibited until November 4, 2028, from becoming or acting as a director or officer any issuer.
