Background
¶ 1 The TSX Venture Exchange has recognized deficiencies in its rules and has represented that the Rules are being reviewed and amended.
2 The Exchange has applied for an order under section 27 of the Act to vary the Rules.
3 The Commission has reviewed the affidavit of Barbara Insley and submissions of the Exchange.
4 Peter Rook-Green and Christopher Serin have consented to the order with conditions, which the Exchange accepts.
Order
¶ 5 The Commission, considering it to be in the public interest, orders:
· that the individuals in Schedule A attached comprises the Hearing and Review Chairperson Roster and Listed Company Review Panel Roster for any hearing and review conducted by the Exchange pursuant to the Rules in respect of Peter Rook-Green and Christopher Serin; and
· that any decision by a Listed Company Review Panel consisting of individuals selected from Schedule A has the same force and effect as a decision of a Listed Company Review Panel contemplated by the Rules, and carries with it the same rights to a hearing and review under the provisions of the Act.
