¶ 1 On December 1, 2009, the Executive Director issued an Amended Notice of Hearing under section 161 of the Securities Act, RSBC 1996, c. 418, naming as Respondents Steven Peter Kyllo, Mercury Capital S.A., Moenkopi Resources Inc., Frey Mining Company Ltd., Glen Matthew, David Malcolm Ruthven and Cheryl Anne Kyllo.
¶ 2 On January 20, 2010, the Executive Director entered into a settlement agreement with Cheryl Anne Kyllo.
¶ 3 The Executive Director, considering it would not be prejudicial to the public interest to do so, discontinues the proceedings against Cheryl Anne Kyllo.
