Notice of Discontinuance

Anwar Badshah and Badshah
Communications Group Ltd.

Securities Act, RSBC 1996, c. 418

¶ 1 On November 27, 2007, the Executive Director issued a Temporary Order and Notice of Hearing under section 161 of the Securities Act, RSBC 1996, c. 418 (the Act) naming Anwar Badshah (Badshah) and Badshah Communications Group Ltd. (Badshah Communications) as respondents.

¶ 2 On December 6, 2007, the British Columbia Securities Commission issued a Hearing Adjournment and Extension of Temporary Order extending the November 27, 2007 Temporary Order until a hearing was held and a decision rendered.

¶ 3 On September 3, 2009, in the Provincial Court of British Columbia, Badshah guilty to, and was convicted of, three counts of securities related fraud.  These counts relate to some of the misconduct alleged in the Notice of Hearing. The presiding judge sentenced Badshah to an 18-month conditional sentence.

¶ 4 On January 20, 2011, in 2011 BCSECCOM 39, the Commission issued a Reciprocal Order against Badshah under section 161(6)(b) of the Act based on his conviction in the Provincial Court.

¶ 5 The Executive Director, considering it would not be prejudicial to the public interest to do so, discontinues the proceedings against Badshah and Badshah Communications.
