Decision
Introduction
¶ 1 On July 15, 2008 we made orders against George Schwartz, among others, under sections 161(1) and 161(6)(c) of the Securities Act, RSBC 1996, c. 418 (see 2008 BCSECCOM 403).
Background
¶ 2 Schwartz was given an opportunity to be heard, on or before July 11, 2008, before we made the orders. He made submissions by fax before July 11 but, due to an administrative error, we did not receive his submissions before making the orders. When he became aware of the orders, he inquired on July 18, 2008 whether we had received and considered his submissions. We are treating his inquiry as an application under section 171 of the Act to revoke or vary the orders.
