BCSC panels reciprocate ASC, OSC and SFSC reciprocal orders

Vancouver - British Columbia Securities Commission panels have reciprocated enforcement orders against 18 individuals sanctioned by securities commissions in Alberta, Ontario and Saskatchewan.

The Alberta Securities Commission imposed sanctions against Benhard Andrew Anderson, Daren M. Broers, Maxine Cooke, Vincent Emile Ghazar, Fadi Hurani, Rene Laprade, Gary Warren Michaels, and Leslie Ryan Stevenson in various decisions made between September 2008 and April 2009. The BCSC panel reciprocated the ASC enforcement orders against the eight individuals, banning them from participating in B.C.’s capital markets.

The Ontario Securities Commission imposed sanctions against David Cathcart, Brian H. Crombie, Kenneth G. Howling, Cynthia Jordan, Kwok-On Aloysius Lo, Allan McCaffrey, Michael Shumacher, Christopher Smith, and Michael Zelyony in decisions made between January and March 2009. The BCSC reciprocated OSC enforcement orders against the nine individuals, banning them from participating in B.C.’s capital markets.

The Saskatchewan Financial Services Commission imposed sanctions against Klaus Link in a decision made on April 21, 2009. The BCSC panel reciprocated the SFSC enforcement order, permanently banning Link from participating in B.C.’s capital markets.

The BCSC reciprocates enforcement orders made by other securities commissions. BCSC orders include the same sanctions, except where the other securities commissions prohibit persons from becoming or acting as directors or officers of any issuer. In those circumstances, the BCSC orders also include the following sanctions:

  • a prohibition from becoming or acting as a director or officer of any registrant or investment fund manager;
  • a prohibition from becoming or acting as a registrant, investment fund manager or promoter;
  • a prohibition from acting as a manager or consultant in the securities market; and
  • a prohibition from engaging in investor relations activities
