  • BC Notice 2004/20 - New Securities Legislation

    This Notice announces that the BC government today introduced a new Securities Act for British Columbia. The new Act adopts a results-based approach to securities regulation, based on existing principles. The new Act is part of an overall new legislative framework. The rules, forms and accompanying guidance will be published for further comment in June 2004.

    BC Notice 2004/21 - Cost Savings Under a Firm-Only Registration

    SystemThis notice announces the results of the Commissionand's analysis of potential cost savings of a firm-only registration system and the publication of the study.

    The study found savings that, while significant in percentage terms, were more modest in absolute dollars. Given that there are policy arguments for it, in addition to whatever cost savings it may bring, we expect the draft rules that will be published for comments in June will include an exemption to implement firm only.

  • BC Notice 2004/22 - Investor Remedies in Securities Legislation
    A Regulatory Impact Analysis

    This notice publishes the Commission's analysis of the potential impact of various forms of investor remedies. The study explains why Bill 38 includes the investor remedies it does. Bill 38 continues most of the remedies in the current Securities Act and includes new rights of action for misrepresentation in continuous disclosure.

  • BC Notice 2004/23 - Enforcement of Outcomes-Based Securities Legislation

    This notice publishes the Commission's analysis of the enforceability of outcomes-based securities legislation. The study concludes that the new legislation would provide a solid foundation to take enforcement action against market misconduct.
