BCN 2002/11 - Recognition of Market Regulation Services Inc. Notice of Approval [BCN - Rescinded]

On February 1, 2002, the Commission recognized Market Regulation Services Inc. (RS Inc.) as a self-regulatory body under the Act. RS Inc. will operate as a regulation services provider under the Alternative Trading System rules and will administer and enforce trading rules for the marketplaces that retain its services, including the Canadian Venture Exchange Inc.

Alberta, Manitoba, Ontario and Québec have also recognized RS Inc. as a self-regulatory organization.

As part of the recognition of RS Inc., the Commission

1. issued an order for the recognition of RS Inc. (COR#02/015), a copy of which  is attached.

2. approved the adoption of the Universal Market Integrity Rules (UMIRs). A copy of the UMIRs and the policies under the UMIRs is attached.

3. established with the other recognizing regulators an oversight program for RS Inc.   The oversight program, set out in the attached memorandum of understanding, includes reviewing and approving new and amended RS Inc. rules under a joint rule review protocol, reviewing information filed by RS Inc. and performing examinations of RS Inc.’s regulation services.  

On October 12, 2001, the Commission published a notice and request for comment on RS Inc.’s application for recognition (BCN 2001/69). Eight commentators responded to this request for comments. On January 11, 2002, the Commission published a further notice and request for comment on RS Inc.’s revised fee model (BCN 2002/03) and received two additional comment letters. We attach the summary of comments and responses for each notice.
