BCN 2002/42 - Advance Notice of Amendments to National Instrument 14-101 Definitions [BCN - Rescinded]

Introduction
The commission, together with the other members of the Canadian Securities Administrators (CSA), intends to amend National Instrument 14-101 Definitions
(NI 14-101).

If the required government approval is obtained in British Columbia, we intend to make the amendments effective December 31, 2002, when the amendments are expected to come into force in all CSA jurisdictions. We will publish the amendments at that time.

NI 14-101 came into force on April 1, 1997. Its purpose is to ensure a consistent approach to the interpretation and application of national and multilateral instruments. It provides a framework of defined terms that the CSA have agreed to and definitions of commonly used terms.

NI 14-101 is amended from time to time. We published these amendments for comment on September 28, 2001.

Summary of Amendments
The amendments add a reference to Nunavut in the appendices to NI 14-101. They also add and clarify some definitions and delete other terms that are unnecessary. 

The amendments add the terms provincial and territorial securities directions, provincial and territorial securities legislation and provincial and territorial securities regulatory authorities. These terms have the same definitions as Canadian securities directions, Canadian securities legislation and Canadian securities regulatory authorities, and will be the terms used in future national and multilateral instruments in the same context. Because these latter terms are used in existing national and multilateral instruments, they have not been deleted from NI 14-101. 

When published for comment, the proposed amendments suggested the addition of some other terms. Since these terms are either not expected to be used often or are already defined in another instrument, they are no longer included in the amendments.
