Background
The amendments to the Securities Act are contained in the Securities Amendment Act, 1989, S.B.C. 1989, c. 78, Securities Amendment Act, 1990, S.B.C. 1990, c. 25, Securities Amendment Act, 1992, S.B.C. 1992, c. 52, and Securities Amendment Act (No. 2), 1995 S.B.C. 1995, c. 45. All amendments to the Act have been previously published in the Weekly Summary. The amendments to the Securities Act are discussed in NIN#95/40.
The Securities Amendment Act (No. 2), 1995 granted the Commission rule-making power. The Rules are discussed in NIN#95/41.
The amendments to the Regulation and Registration Transfer Regulation were first published for comment on October 7, 1994 in a Special Supplement to the Weekly Summary. The comments have been considered and changes have been made where appropriate. The changes are discussed in in NIN#95/41 and NIN#95/42.
Related initiatives
The Superintendent is specifying certain forms contemplated by the Rules and Regulation in NIN#95/44. The Commission is repealing Local Policy Statement 3-30 - Underwriter's Conflict of Interest, which is discussed in NIN#95/45.
Fee checklist
A revised fee checklist will be available for pick up from the Commission's 11th floor receptionist on January 2, 1996.
Future initiatives
The Commission will publish Local Policy Statement #3-22 - Registration Requirements in final form, and Interim Local Policy Statement #3-24 - Statutory and Discretionary Exemptions before January 1, 1996, the effective date of the legislative amendments. The Commission will be seeking comment on Interim Local Policy Statement #3-24, however both Local Policy Statements will come into effect on January 1, 1996.
Information sessions
The Commission is offering information sessions to help securities industry participants understand how the legislative changes will affect their work. The schedule of the information sessions is set out in NIN#95/38.
Additional copies
Additional copies of the Special Supplement will be available for pick up from the Commission's 11th floor receptionist from 8:30 a.m. - 4:30 p.m. at a cost of $15 each. The Commission will mail a maximum of three copies per person at a cost of $17.50 each (including $2.50 postage). If more than three copies are required, you will be asked to make arrangements to have them picked up from the 11th floor receptionist. The Special Supplement is the authoritative source of the legislative changes.
Carswell is preparing a Supplement to the British Columbia Securities Act and Regulation Annotated, 1996, which will contain the Rules, new Regulation and Registration Transfer Rules, and specified forms. The Supplement will be available in early 1996 and sent automatically to standing order subscribers to the Annotation. The Carswell Annotation already contains the amendments to the Securities Act in shaded print following the provisions that they will replace.
