BC Notice 2005/43 - Notice of Multilateral Instrument 11-101 Principal Regulator System Form 11-101F1 Notice of Principal Regulator and Companion Policy 11-101CP Principal Regulator System and Consequential Amendments to National Policy 12-201 Mutual Reliance Review System for Exemptive Relief Applications, National Policy 43-201 Mutual Reliance Review System for Prospectuses, National Instrument 51-101 Standards of Disclosure for Oil and Gas Activities and Multilateral Instrument 81-104 Commodity Pools

This notice announces the adoption of principal regulator system (MI 11-101, its related form and companion policy) effective September 19, 2005. The principal regulator system will give a market participant access to the capital markets in multiple jurisdictions by dealing with the regulator and the law of its principal jurisdiction. The notice also announces the concurrent adoption of related amendments to NI 51-101Standards of Disclosure for Oil and Gas Activities, MI 81-104 Commodity Pools, NP 43-201 Mutual Reliance Review System for Prospectuses andNP 12-201 and Mutual Reliance Review System for Exemptive Relief Applications. The notice includes a summary of comments and responses.

This notice announces the adoption of a number of instruments to allow British Columbia to participate in the principal regulator system (see BC Notice 2005/43). They are MI 52-109 Certification of Disclosure in Issuers' Annual and Interim Filings, its companion policy and related forms, BCI 52-510 (which varies MI 52-109's transition provisions and provides some exemptions), new BCI 51-801 (which partially removes some exemptions from NI 51-102 Continuous Disclosure Obligations) and BCI 44-502 (which varies the implementation rules for NI 44-101 Short Form Prospectus Distributions, NI 44-102 Shelf prospectus and NI 44-103 Post-Receipt Pricing).

CSA Notice 12-309 - Impact of the MI 11-101 Principal Regulator System on the Mutual Reliance Review System for Exemptive Relief Applications

This notice explains the impact of MI 11-101 Principal Regulator System on the Mutual Reliance Review System for Exemptive Relief Applications (MRRS system). It provides examples for filers of who their principal regulator will be under each system, where a filer might require relief, and provides new templates of decision documents for filers to use when filing an application under the principal regulator system.
