Findings
I Introduction
- This is the liability portion of a hearing under sections 161(1) and 162 of the Securities Act, RSBC 1996, c. 418.
- In a notice of hearing issued June 28, 2017 (2017 BCSECCOM 218), the executive director alleged that:
a) between December 2012 and December 2015, Mountainstar Gold Inc. made false or misleading statements in its required public filings concerning certain Chilean mining claims and related legal proceedings, or omitted facts that were necessary to make the statements not false or misleading, contrary to section 168.1(1)(b) of the Act, and
b) as an officer and director of Mountainstar, Brent Hugo Johnson authorized, permitted or acquiesced in Mountainstar's contraventions and he therefore contravened that same provision under section 168.2 of the Act. - During the hearing, the executive director called two witnesses: a Commission investigator and O, who the executive director asked to be qualified as an expert witness. The qualification of this witness is discussed below under "Preliminary Issues - Expert witness". The executive director also tendered documentary evidence and made written and oral submissions.
