Substance and purpose of the instruments
Effective January 28, 2009, the Commission, together with other Canadian Securities Administrators, is adopting amendments to:
- National Instrument 21-101 Marketplace Operation
- Companion Policy 21-101CP Marketplace Operation
- National Instrument 23-101 Trading Rules
- Companion Policy 23-101CP Trading Rules
The amendments include requirements that all visible, immediately accessible, better-priced limit orders be filled before limit orders at inferior prices, regardless of the marketplace where the order is entered (order protection amendments). Other amendments include a prohibition on intentionally locking or crossing markets.
Advance notice
We provided advance notice of these amendments on November 13, 2009, and notice of a technical correction on December 18, 2009. Please see those notices for more information.
Effective date
The amendments, other than the order protection amendments, will be effective January 28, 2010. The order protection amendments will be effective February 1, 2011.
