Policies & Instruments

  • BC Notice 2003/08 - Amendments to National Policy 11-201 Delivery of Documents by Electronic Means

This Notice announces the adoption of amendments to NP 11-201 concerning the electronic delivery of proxy documents and the use of electronic formats for proxies.

  • Joint Forum 81-403 Consultation Paper - Rethinking Point of Sale Disclosure for Segregated Funds and Mutual Funds

This consultation paper seeks comment on proposals for a new mutual fund disclosure regime. The regime would replace the current simplified prospectus and annual information form required by NI 81-101 Mutual Fund Prospectus Disclosure with a new four component system.

The four components are:

  • a brief 1-2 page fund summary of key information an investor would need to make a decision about investing in the fund.
  • a foundation document which would contain the rest of the more detailed information about the fund.
  • a consumers guide that would educate consumers about the key elements of a mutual fund and an individual variable insurance contract (commonly called a segregated fund)
  • enhanced continuous disclosure as described in proposed NI 81-106 Investment Fund Continuous Disclosure

There would be a new requirement to give prospective investors the information in the fund summary before they make investment decision. Because an investor would get the information they need to make an investment decision before making that decision, the proposals contemplate removing the current rights of withdrawal and rescission.

The proposals contemplate investors being able to receive or access these documents in various formats. Delivery of a paper copy will not be required unless an investor requests it.

The comment period closes on April 30, 2003.
