The British Columbia Securities Commission is adopting Amendments to National Instrument 81-102 Mutual Funds and to National Instrument 81-101 Mutual Fund Prospectus Disclosure and Form 81-101F1 Contents of Simplified Prospectus and Form 81-101F2 Contents of Annual Information Form and Companion Policy 81-102CP (the amendments). These amendments are effective on December 31, 2003.
Substance and purpose of the amendments
The purpose of the amendments is to provide a regulatory framework to permit mutual funds to invest in other mutual funds that is appropriate to ensure investor protection, and to permit mutual funds to realize the potential benefits of these transactions for their securityholders. The amendments also make various “housekeeping” changes to the existing rules.

Prior publications
We published for comment a previous version of the amendments on July 19, 2002 (BCN 2002/31). On October 10, 2003, we published advance notice that, subject to government approval, we expected to adopt the amendments and implement them as rules effective December 31, 2003 (BCN 2003/41). At that time we also published a summary of the comments we had received about the amendments, and our responses.
