NIN 96/02 - Rule Making Procedure Regulation [NIN - Rescinded]

The Commission is publishing the Rule Making Procedure Regulation (the "Regulation"), which took effect on January 1, 1996, by B.C. Reg. 497/95. A copy of B.C. Reg. 497/95 is attached.

The Regulation sets out the procedure that the Commission must follow when making a rule under section 159.1 of the Act. The procedure involves obtaining prior ministerial approval in principle (section 2 of the Regulation), publication of the proposed rule for comment (section 3(1)), republication of the rule if, as a result of comments received, the Commission is of the opinion that the changes alter the rule in a material way (section 4(b)), obtaining ministerial consent to the rule in final form (section 5(1)), and republication of the rule in final form (section 7). A procedure exists for the Commission to make rules on an urgent basis without publication for comment under section 159.1(7) of the Act (section 6); such rules are automatically revoked 275 days after being made (section 6(4)).
