BCN 2012/21 - Specification of Forms for Summons to Attend and Demand for Production of Records [BCN]

Where the Act or regulations provide that a record be in a required form, under section 182(1) of the Act the Executive Director may specify the form.

Section 10 of the Securities Regulation, B.C. Reg. 196/97 requires that

  • a summons to attend before an investigator under section 144(1)(a) of the Act and
  • a demand for production of records and things under section 144(1)(c) of the Act

must be in the required form.

Pursuant to section 182(1) of the Act, the Executive Director specifies that

  • the attached form 15-901F is the required form for a summons to attend before an investigator under section 144(1)(a) and
  •  the attached form 15-902F is the required form for a demand for production of records and things under section 144(1)(c) of the Act.

These new forms replace the current forms 15-901F and 15-902F effective today however for a summons or a demand issued before October 1, 2012, the old forms can be used.
