NIN 94/27 - New Form of Certificate under Section 60(3) of the Securities Act [NIN - Rescinded]

Section 11 of the Securities Amendment Act, 1992, S.B.C., 1992, c. 52 (the "Amendment Act"), brought into force effective November 17, 1994 by B.C. Reg. 418/94 (see NIN#94/25), amends section 60(3) of the Securities Act (the "Act") by narrowing the language of the certificate that the Superintendent may issue under that section to refer to not being in default of filing financial statements and fees.

Before the implementation of section 11 of the Amendment Act, the Superintendent had already indicated in NIN#93/19 that he was no longer prepared to exercise his discretion to issue a certificate that an issuer is not in default of any requirement of the Act or Regulation as was then possible under section 60(3) of the Act.

Effective November 23, 1994, the Superintendent will, in appropriate circumstances, issue the form of certificate attached to this Notice under section 60(3) of the Act.
