BCN 2011/25 - Adoption of BC Instrument 45-532 Exemption for use of information by representatives of the media and BC Instrument 45-533 Exemption from Form 45-106F6 requirements for investment funds and foreign public issuers [BCN]

On August 10, 2011, the Commission gave advance notice of the adoption of Form 45-106F6 British Columbia Report of Exempt Distribution (BCN 2011/22) and certain amendments to National Instrument 45-106 Prospectus and Registration Exemptions

The amendments to NI 45-106 include a new section that restricts the use of information about individual purchasers to research for investment purposes (the prohibition). The Commission stated in the advance notice that it would provide the media with an exemption from the prohibition.

Since the advance notice, the Commission has received comments concerning possible difficulties investment funds and foreign issuers will have completing the additional information required in the Form.

Effective October 3, 2011, the Commission is adopting

  • BC Instrument 45-532 Exemption for use of information by representatives of the media
  • BC Instrument 45-533 Exemption from Form 45-106F6 requirements for investment funds and foreign public issuers.
