BOR 92/01 - Fees Payable by Members of the Press for a Subscription to the Weekly Summary and for Search of a File [Rescinded]

IN THE MATTER OF THE SECURITIES ACT S.B.C. 1985, c. 83 AND

IN THE MATTER OF FEES PAYABLE BY MEMBERS OF THE PRESS FOR A SUBSCRIPTION TO THE WEEKLY SUMMARY AND FOR SEARCH OF A FILE

Variation Order and Waiver Under Section 183(1.1) of the Regulation

WHEREAS items 28 and 36 of section 183(1) of the Securities Regulation, B.C. Reg. 270/86 (the "Regulation") prescribe the fees payable for search of a file and for an annual subscription to the periodical referred to in section 152 of the Regulation (the "Weekly Summary");

AND WHEREAS section 183(1.1) of the Regulation authorizes the Commission to order that items 28 and 36 of section 183(1) of the Regulation be varied, by reducing the fee payable, or do not apply in respect of a person who is a representative of the media or any class of persons who are representatives of the media;

AND WHEREAS, for the purpose of this order, a member of the press includes

(a) a newspaper, magazine, radio or television station, or other bona fide medium of mass communication, or

(b) a news service, network or other affiliation of newspapers, magazines, radio or television stations, or other bona fide media of mass communication,

but does not include a newspaper, magazine, newsletter, pamphlet or other record published or sponsored by an issuer, registrant, promoter, public relations or investor relations firm, law firm, accounting firm, geological or engineering firm, consulting firm, or other person whose principal business is not publishing;

AND WHEREAS the Commission considers that to do so would be in the public interest; 

IT IS ORDERED under section 183(1.1) of the Regulation that:

1. the fee prescribed under item 36 of section 183(1) of the Regulation be varied by reducing it to $100 per year in respect of a member of the press; and

2. the fee prescribed under item 28 of section 183(1) of the Regulation does not apply in respect of a member of the press who subscribes to the Weekly Summary for the reduced fee of $100 per year.
